Intellectual Property Rights at Lane

SUPPORTING FACULTY

LCC should adopt a model similar to Hal Plotkin and De Anza CC whereby the college officially supports faculty who develop materials and share them with Creative Commons copyright.

In practice, this ("officially supports") means that curriculum development funds will ONLY be given to instructors who:
#1 copyright their work with Creative Commons (this to include instructor name and institution "Lane Community College")
AND 
#2 deposit the learning materials in an OER server space, such as Hippocampus, Rice University OER, etc.


OWNERSHIP

Instructors who develop courses on their own, without receiving specific and additional curriculum development funds, maintain the intellectual property rights to that material.  All instructors will be encouraged to share their materials to the OER community by obtaining Creative Commons copyrights.

The college cannot claim ownership of courses where instructors have chosen to use copyrighted materials, such as those from a textbook publisher.  (testbanks, images, documents, etc.)  

The college cannot claim ownership (and try to sell courses) where the instructor has used OER materials, which specifically prohibit selling/using those materials for profit.

The instructor is also limited to claiming ownership if course materials include copyrighted textbook publisher materials or OER materials.  Instructors may only claim ownership of materials they produce without receiving curriculum development funds specified for that purpose.
